Master Service Terms

These Master Service Terms ("Terms") govern all services provided by PlugMySite ("PlugMySite", "we", "us") to any customer ("Client", "you"). By placing an order, paying any fee or deposit, or instructing us to begin work, you agree to these Terms. They are incorporated by reference into every order and quotation.

1.Services & scope

PlugMySite provides plug-and-play website upgrades, templates, integrations, and related services as described in the applicable order or quotation (the "Services" and the resulting deliverables, the "Deliverables"). The scope of an engagement is limited to what is expressly stated in that order. Anything not expressly included — additional pages, integrations, redesigns, or features — is out of scope and, if requested, is quoted and invoiced separately.

2.Delivery timeline

Quoted turnaround times (for example, "three-business-day delivery") are good-faith estimates. The delivery period begins only once the Client has furnished all materials reasonably required to perform the Services, including copy, imagery, brand assets, third-party account credentials, and written approvals. PlugMySite will confirm the commencement date in writing. Any delay caused by incomplete, inaccurate, or late Client submissions extends the timeline on a day-for-day basis and does not constitute a default by PlugMySite. Business hours are 9:00am–6:00pm Eastern Time, Monday–Friday, excluding US public holidays.

2A.Third-party dependencies & processor timelines

Certain Services depend on third-party providers (including but not limited to Stripe, Square, PayPal, Clover, Twilio, Google, and domain registrars). Quoted delivery timelines assume the Client's accounts with these providers are in good standing and that any required verification, identity checks, or compliance reviews by the third party have been completed.

Payment processor timelines. Stripe-based integrations are typically deliverable within two (2) business days after the Client completes Stripe's identity verification. Integrations with Square, PayPal, Clover, or other non-Stripe processors may require additional provider-side onboarding, compliance review, API credential provisioning, or hardware setup that is outside PlugMySite's control. PlugMySite does not guarantee delivery timelines for third-party provider processes and is not liable for delays caused by provider verification, account holds, compliance reviews, or credential issuance.

The Client is responsible for: (a) completing all third-party account sign-ups and verification steps promptly; (b) providing API keys, credentials, and access as requested; (c) ensuring their business meets the third-party provider's eligibility requirements. PlugMySite will make commercially reasonable efforts to assist, but delays arising from third-party provider processes do not constitute a default by PlugMySite and do not entitle the Client to a refund.

3.Fees & finality of payment

All fees are payable in advance and are deemed fully earned upon receipt. Except where a non-waivable right is granted by applicable law, all payments are final and non-refundable, and the Client expressly waives any right to initiate a chargeback, dispute, or payment reversal — irrespective of change of mind, the Client's business circumstances, or events outside PlugMySite's reasonable control.

Transaction processing fees and applicable sales tax are added at checkout and disclosed before payment. PlugMySite's sole obligation in consideration of payment is to deliver the Services substantially as described in the applicable order.

Payment processing fees. Where PlugMySite provisions a payment integration for the Client, transactions on the Client's site or register are subject to an all-in processing fee that covers both the third-party processor and the PlugMySite platform fee. Current rates: 3.1% + 30¢ per online (card-not-present) transaction, 2.9% per in-person (card-present) transaction, and 3.6% per manually-keyed transaction, with no monthly fee on the standard tier. Volume/Enterprise rates are quoted separately. Rates may change with notice and are always shown before payment.

Domain registration. Website builds include registration of one (1) domain free for the first year, for any domain whose registry price is $15.00/yr or less. Where the Client selects a premium or higher-priced domain (registry price above $15.00/yr), the Client pays only the amount exceeding $15.00/yr. Renewals after the first year are billed at the registrar's then-current standard rate (typically approximately $15/yr) and are the Client's responsibility. The free-domain benefit is one per build and is non-transferable and non-refundable once a domain is registered.

4.Deposits & staged payments

Certain larger engagements are offered on a staged-payment basis. Where an order is marked as deposit-based, the following applies:

Growth deposit terms. By paying the stated deposit (for example, a 20% deposit on a fixed-scope build), the Client commits to the full contract value of that build. The deposit is non-refundable and is applied in full toward the final invoice. The remaining balance becomes due on delivery of the Deliverables and is invoiced via Stripe. Work on a deposit-based engagement begins only after the deposit clears. If the Client cancels after the deposit is paid, the deposit is forfeited; if the Client cancels after work has begun, PlugMySite may additionally invoice for work performed up to the cancellation date. The fixed scope, contract value, and remaining balance are stated on the order at the time the deposit is paid.

Staged-payment engagements are otherwise governed by all other provisions of these Terms, including the finality-of-payment and limitation-of-liability clauses.

5.Limited workmanship warranty

For fourteen (14) calendar days following delivery, PlugMySite will remediate, at no additional charge, any defect arising directly from its own workmanship (a "Covered Defect"). This limited warranty is the Client's sole and exclusive remedy in respect of the Deliverables. After the warranty period expires, remediation is billable on a per-incident basis at PlugMySite's then-current rates, or is provided at no additional charge while a Maintenance subscription remains active.

6.Exclusions & Client responsibilities

The limited warranty does not extend to, and PlugMySite is not responsible for, any issue arising from a cause outside its control, including:

PlugMySite will, on request, provide diagnostic findings for such issues; any resulting remediation is quoted and invoiced separately. The Client is responsible for the lawfulness of its business and of all content it supplies.

7.Maintenance subscriptions

Maintenance subscriptions are billed monthly in advance and may be cancelled at any time, effective at the end of the then-current billing period; partial months are not refunded. Coverage applies only to Deliverables built by PlugMySite and is subject to the inclusions and service levels stated for the applicable subscription tier.

8.Intellectual property

Upon receipt of all fees due for an engagement, the Client owns the final Deliverables produced specifically for it, together with its own content and customer data. PlugMySite retains ownership of its pre-existing tools, templates, libraries, and know-how, and grants the Client a non-exclusive license to use those components solely as embodied in the Deliverables. PlugMySite may describe the engagement in its portfolio unless the Client requests otherwise in writing.

9.Limitation of liability

To the maximum extent permitted by law, PlugMySite's total aggregate liability arising out of or relating to any order is limited to the fees actually paid by the Client for that order. PlugMySite is not liable for any indirect, incidental, special, punitive, or consequential loss, including lost profits, lost revenue, business interruption, or loss of data. The Services are provided on an "as described" basis and PlugMySite does not warrant uninterrupted or error-free operation.

10.Payment integration (Stripe Connect)

PlugMySite offers an optional payment integration feature that enables Clients to accept payments from their own customers directly through their websites. This feature is powered by Stripe Connect. By activating payment integration, the Client agrees to the terms in this section in addition to all other provisions of these Terms.

10.1 Stripe agreements

Payment processing services for Clients on PlugMySite are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the "Stripe Services Agreement"). By connecting a Stripe account through PlugMySite, the Client agrees to be bound by the Stripe Services Agreement, as the same may be modified by Stripe from time to time. As a condition of PlugMySite enabling payment processing through Stripe, the Client agrees to provide PlugMySite accurate and complete information about the Client and its business, and the Client authorises PlugMySite to share it and transaction information related to the Client's use of the payment processing services provided by Stripe. Stripe's handling of personal data is governed by the Stripe Privacy Policy.

10.2 Fees — platform fee + payment processing fee

Two separate fees apply to each successful transaction processed through the Client's connected Stripe account:

Example: on a $100 charge, DIY keeps $93.80; Concierge keeps $94.80.

PlugMySite platform fee — retained by PlugMySite as compensation for providing the payment integration infrastructure, API, and ongoing support. This fee is deducted automatically from each payment before the remaining funds are transferred to the Client's bank account via Stripe.

Stripe processing fee — charged by Stripe for payment processing, fraud prevention, and fund settlement. Currently 2.9% + 30 cents per successful card charge for US-based accounts (see Stripe Pricing for current rates and international card surcharges). This fee is set by Stripe and may change; PlugMySite does not control Stripe's pricing.

No setup fees for the DIY tier. The Concierge tier may include a one-time setup fee as quoted.

PlugMySite reserves the right to change the platform fee upon 30 days' written notice to the Client; the Client may terminate the payment integration before the new fee takes effect. Changes to Stripe's processing fee are governed by the Stripe Services Agreement and are outside PlugMySite's control.

10.3 Fund flow & merchant of record

When a Client's end customer makes a payment, the Client is the merchant of record for that transaction — not PlugMySite. Funds flow from the end customer through Stripe to the Client's connected account, minus the platform fee and Stripe processing fees. PlugMySite does not hold, pool, or control any funds owed to the Client at any time; Stripe manages the entire settlement and payout process in accordance with the Stripe Services Agreement.

10.4 Client responsibilities

The Client is solely responsible for:

10.5 Termination of payment integration

Either party may terminate the payment integration at any time. PlugMySite may suspend or disconnect a Client's Stripe account immediately if: (a) the Client violates the Stripe Services Agreement or card network rules; (b) the Client's chargeback or dispute rate exceeds acceptable thresholds; (c) PlugMySite reasonably suspects fraudulent activity; or (d) Stripe suspends or terminates the Client's account for any reason. Termination of the payment integration does not affect the Client's other PlugMySite services or obligations under these Terms.

10.6 Stripe acquirer disclosure

For card-present and card-not-present transactions processed through Stripe Connect, the acquiring bank is Wells Fargo Bank, N.A. (or such other acquirer as Stripe designates from time to time). 11.Disputes, chargebacks & refund policy

11.1 Direct purchases from PlugMySite

All fees paid directly to PlugMySite for site builds, templates, and integrations are subject to the finality-of-payment clause in Section 3. PlugMySite offers a 14-day workmanship warranty on delivered work (Section 5). Refunds for PlugMySite services, if any, are issued exclusively through the Stripe Dashboard at PlugMySite's sole discretion. No automated refund endpoints exist in the platform.

Chargeback policy. PlugMySite uses manual payment capture on all checkouts. If a payment is not yet captured, it can be released at zero cost. Once captured, the Client agrees not to initiate a chargeback, dispute, or payment reversal except in cases of documented fraud or unauthorised card use. Fraudulent or abusive chargebacks may result in suspension of the Client's account and collection of associated Stripe dispute fees ($15 per dispute).

11.2 Transactions on Client sites (via Stripe Connect)

For payments processed on a Client's website through the Stripe Connect integration, the Client — as merchant of record — is responsible for managing refunds, returns, and customer disputes in accordance with the Client's own published refund policy and the Stripe Services Agreement. PlugMySite is not a party to transactions between a Client and the Client's end customers and has no liability for such transactions. Chargebacks on connected-account transactions are debited from the Client's connected Stripe balance per Stripe's standard dispute process. Platform fees on disputed and subsequently refunded transactions are not refundable.

12.Community board & user content

The PlugMySite community board lets visitors submit posts. By submitting a post you grant PlugMySite a non-exclusive, royalty-free license to display, store, and moderate that content. All submissions are reviewed before publication; PlugMySite may decline, edit, or remove any submission at its discretion, and is not obligated to publish any post. You must not submit content that is unlawful, infringing, defamatory, deceptive, or that contains passwords, payment details, or another person's personal information. You are solely responsible for the content you submit.

13.General

PlugMySite may amend these Terms from time to time; the version in effect at the time of your order governs that order. If any provision is held unenforceable, the remaining provisions remain in full force. These Terms, together with the applicable order, constitute the entire agreement between the parties and supersede prior discussions. Your use of the website is also governed by our Privacy Policy.
